Learning Objectives

  • LO STATO E LE SUE FONTI. L'ORGANIZZAZIONE DELLO STATO E DELLA REPUBBLICA
    Module 1 is intended to introduce the general notions on legal sources and types of constitutions and the study of the Italian Constitution. It is also intended to provide general knowledge about the State and specific knowledge about the Italian constitutional organization and the constitutional bodies, on Italian internal sources and on the European and on their relationships.
  • DIRITTI FONDAMENTALI: GIUSTIZIA ORDINARIA E COSTITUZIONALE
    Module 2 is intended to provide specific knowledge about freedoms and the rights guaranteed by the Constitution, on the functioning of the Constitutional Justice, the order of magistrates and the constitutional system of the judiciary.
    The module also provides specific insights on the constitutional position of the minister of justice, the control over the judiciary and disciplinary functions of the Supreme Judicial Council.

    Sources of production. Sources of knowledge. Sources-fact and sources-act. Techniques for referral to other jurisdictions. The function of interpretation. The conflicts and resolution techniques. The chronological criterion and repeal. The hierarchic criterion and annullment. The criterion of specialty. The criterion of competence. Subject to the law and rule of law. Meaning of "constitution". Constituent power and constituted powers. Constitutions "flexible" and constitutions "rigid". The guarantees of the constitutional "rigidity". Written constitution and constitutional law. Dispositions, norms, rules, principles, values, interests. The Italian Constitution. The State. Forms of State. Forms of Government. The Government.
