Learning Objectives

• L'ORGANIZZAZIONE COSTITUZIONALE DELLO STATO E LE GARANZIE DEI DIRITTI FONDAMENTALI
  The aim of the course is to provide the students with the relevent tools and techniques to understand what a legal system is through identifying and understanding existing legislation and law within the Italian Carta Costituzionale.

  Through the study of the text of the Italian Constitution, the second module aim to provide basic knowledge of our Constitution system.

Detailed Course Content

• L'ORGANIZZAZIONE COSTITUZIONALE DELLO STATO E LE GARANZIE DEI DIRITTI FONDAMENTALI

  The program of this module will be to study law, not only Italian law but also the laws introduced and governed by the European Union. A fundamental part of the course is the study of the Costituzione and hierachy of the law system and the criteria used for the interpretation of the law. The program focuses on the examination of Fundamental Rights, both traditional ones (specifically provided for by the Italian Constitution), and those of new generation, not expressly provided for the Constitution, but implied by various rules. The attention will be carried on the International Treaties of the protection of Human Rights, such as the Universal Declaration of Human Rights, the ECHR, the Treaty of Nice. It will be examined the debate on their protection, the damages - especially the existential damage - the competent Court and the possible forms of compensation. Other topics will be the birth of the European Union, the characteristics of European law, the differences of the ECJ and ECHR.

• I LUOGHI DI SVILUPPO DELLA "PERSONALITA'" (FAMIGLIA, SCUOLA, PARTITI, SINDACATO E CHIESA)

  We will start by looking at the constitutional court: the Parliament, the Government, the president of the Italian republic, the Constitutional court. We will describe their characteristics, how they are formed, their functions as well as the relationships between them. We will look at the judicial system (Magistratura): how it functions and how the Magistratura oversees the judges work. We will look in more detail at the freedom of the Magistrature, how it works starting from the Article 105 dedicated to the Consiglio superiore della Magistratura (the high council that governs the judiciary).
