Learning Objectives

Penal System
This module concerns the general part of penal law; particular attention is dedicated to fundamental principles of penal system and to analysis of penal function, crime structure and its consequences. Students will be able to comprehend penal dimension of social problems and to indicate legislative remedies to favour rehabilitation of delinquents.
Penal System concerning Minors
The module regards the study of substantial norms and proceedings mechanisms concerning minors who commit crimes. Peculiar attention is dedicated to legislative solutions whose aim is rehabilitation of delinquents. Students will be able to elaborate adequate projects to intervene in the re-socialization of minors by means of penal system.

Penal System
General part of penal law. Penal system and fundamental principles. History of penal law and penal culture. Penal legislation and the principle of legality. Crime structure. The manifestation forms of crime. The author and the victim of crime. The juridical consequences of crimes: penal sanctions.
Penal System concerning Minors
Constitutional principles of penal system concerning minors. Minors who commit crimes: imputability; sanctions, with particular regard to substitutive sanctions and judicial forgiveness. Penal process concerning minors: preliminary inquiries and precautionary measures; the judgement. Mediation and restorative justice.
